DMCA & Copyright Policy

TullyAPI respects the intellectual property rights of others and expects users to do the same. This policy outlines the procedures regarding copyright infringement claims in accordance with the Digital Millennium Copyright Act (DMCA).

Service Operator

TullyAPI is operated by Tully Blake Martin, a sole proprietorship.

Copyright Ownership

TullyAPI and its original content, features, and functionality are owned by Tully Blake Martin and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

User-Generated Content

TullyAPI does not host or store user content on servers. All user data, including:

• API collections
• Endpoints and configurations
• Request/response data
• API keys and credentials

is stored locally in the user's browser using localStorage. I do not have access to, control over, or responsibility for this content.

Exported Collections

When users export their collections as JSON files, they retain full ownership and responsibility for that content. Users are responsible for ensuring they have the right to share any exported collections and that such sharing does not infringe on any third-party intellectual property rights.

Filing a DMCA Takedown Notice

If you believe that content available through TullyAPI infringes your copyright, you may submit a DMCA takedown notice. However, please note:

• I do not host user-generated content on servers
• User data is stored locally in individual browsers
• I cannot access or remove content from users' browsers

That said, if you believe the source code or website content infringes your copyright, please send a written notice to the designated Copyright Agent with the following information:

Counter-Notice

If you believe your content was wrongly removed due to a DMCA claim, you may file a counter-notice with the same contact information above, including:

• Your physical or electronic signature
• Identification of the content that was removed
• A statement under penalty of perjury that you have a good faith belief the content was removed in error
• Your name, address, and telephone number
• A statement that you consent to jurisdiction of the federal court in your district

Repeat Infringers

TullyAPI does not maintain user accounts. However, I reserve the right to take appropriate action against any party that repeatedly infringes on intellectual property rights, including blocking access to the service if technically feasible.

Fair Use

I recognize that certain uses of copyrighted material may be protected under the fair use doctrine or similar exceptions. Before submitting a DMCA notice, please consider whether the use in question may qualify as fair use.

False Claims

Under the DMCA, anyone who knowingly materially misrepresents that content is infringing may be subject to liability. I may seek damages, including costs and attorney's fees, against anyone who submits a false or fraudulent DMCA notice.

Open Source

TullyAPI is open source software. The source code is available on GitHub and is licensed accordingly. Please review the repository's LICENSE file for details on how you may use, modify, and distribute the code.
